The man accused of murdering Jennifer Hudson’s mother, brother and 7 year old nephew may be getting a legal break due to his family connection.
Defense attorneys for William Balfour are asking that threats William made to Jennifer Hudson’s sister Julia be omitted from court testimony on the grounds of ‘”Marital Privilege”.
At a recent hearing for Balfour, defense attorneys asked that key testimony from Julia Hudson be stricken from the case.
According to Julia, William had been threatening her family right up until the day of the killings, after he found out about her new lover, promising:
“If you ever leave me, I’m going to kill you, but I’m going to kill your family first. You will be the last to die.”
A motion filed by the defense requests that Julia’s statements and any similar to those quoting William be omitted citing “Marriage Privilege” meaning what was said, threat or not, should be considered part of the confidential communication between husband and wife.
Wowzers. The trial is scheduled to begin on April 9th.
